Rule 25
Procedure for auction sale

(1) According to section 39 of the Act, the organization or association shall adopt the following procedure when collecting the dues of the person who has to collect the outstanding dues of the organization or association through auction sale. :-

(a) In the name of the person who is determined to pay the remaining arrears, a letter must be sent to the person to pay the amount to be paid within thirty-five days excluding the time of travel and if the said amount has been paid, the proof should be sent. In this way, if the deadline is issued, if the amount to be paid is not paid within the said period, or if the proof of payment is not submitted, a notice of auction sale shall be published in his name.
(b) If the mortgaged real estate has not been withheld from the Land Registry Office, the proof of the withholding shall be kept.
(c) In case of publishing a notice of auction sale of mortgaged movable immovable property, the details of the mortgage, the sum to be paid, the amount of interest and damages should also be mentioned, within fifteen days in case of movable property and within thirty-five days in case of immovable property, from the date of publication of the notice. "Or the notice about the recovery of the amount of interest and damages shall be published in any of the local or national level newspapers after throwing it in the local village development committee or municipality and in public places.
(d) The auction should start from the opening time of the office and end one hour before the closing time. If a holiday falls on the day that the auction will be held, the auction must be held the next day at the same place and time.
(e) During mortgage auction sale, the price of movable immovable property to be auctioned should be fixed and the price should be increased from the same amount. The auction sale must be approved in the name of the person who has the highest number of votes among the people who are present to speak.
(f) After starting to speak the dak number, the speaker shall clearly open the number spoken by him in the format prescribed by the regulation.

(2) When selling by auction according to sub-rule (1), the district administration office, goods port office and if there is any government office near the place where the auction is to be sold, that office and the representative of the local village development committee or municipality. The auction should be done by keeping a witness and making a bond.

(3) If the representative of any of the offices mentioned in sub-rule (2) does not appear despite the written request, then the present representative and the representative of the village development committee or the municipality should be witnessed. .

(4) In order to collect the remaining arrears, the person whose movable and immovable property is to be auctioned should be sent a notice to attend the auction at the time and place. However, even if the concerned person is not present on the day of the auction sale, it will not be considered as an obstacle to the auction sale.
